These Terms of Service ("Terms") govern your access to and use of the pest control services provided by North Dakota Pest Control ("Company," "we," "us," or "our"). By engaging our services, visiting our website, or contacting us, you agree to be bound by these Terms. If you do not agree with any provision herein, please do not use our services.

Service Description

North Dakota Pest Control provides residential, commercial, and agricultural pest management services throughout the State of North Dakota. Our offerings include, but are not limited to, inspection and identification of pest infestations, treatment applications for insects, rodents, and other wildlife, preventive maintenance programs, integrated pest management consulting, and follow-up monitoring services. Specific treatment methods, products, and service frequencies are determined based on individual property assessments, environmental conditions, and the nature of the pest activity identified. All service agreements are customized to address the unique circumstances of each client property. We utilize EPA-registered products and industry-standard practices consistent with North Dakota regulatory requirements. Service details, including scope, pricing, and scheduling, are confirmed in writing prior to treatment initiation unless otherwise agreed upon for emergency or single-visit services.

No Guarantee or Warranty

North Dakota Pest Control makes no absolute guarantee of complete pest elimination or permanent prevention of future infestations. Pest control results depend on numerous variables beyond our reasonable control, including but not limited to environmental conditions, weather patterns, neighboring property conditions, structural integrity of buildings, client adherence to recommended sanitation and exclusion practices, and pest biology and behavior. We do not warrant that treated premises will remain pest-free indefinitely. Our services are provided on a best-efforts basis using professionally accepted methods. Any warranties or guarantees regarding specific treatment outcomes are limited to the express written terms of individual service agreements, where applicable, and do not extend beyond the scope and duration explicitly stated therein. We reserve the right to modify treatment approaches based on ongoing assessments without prior notice.

User Responsibilities

Clients bear significant responsibility for maximizing treatment effectiveness and maintaining safe conditions during and after service delivery. You agree to provide accurate and complete information regarding pest sightings, property conditions, prior treatments, chemical sensitivities, and presence of children, pets, or vulnerable individuals. Prior to scheduled treatments, you must prepare the premises as instructed, which may include removing food items, covering fish tanks, securing pets, clearing access to treatment areas, and vacating the property for specified periods. You must not interfere with applied treatments, remove bait stations, or apply additional pesticides without our prior consultation. Post-treatment, you are responsible for implementing recommended sanitation improvements, sealing entry points, and reporting persistent pest activity within reasonable timeframes. Failure to fulfill these responsibilities may diminish treatment efficacy and may void any service guarantees. You assume liability for property damage or personal injury resulting from your failure to follow preparation or safety instructions.

Limitation of Liability

To the fullest extent permitted by applicable law, North Dakota Pest Control shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to our services, including but not limited to lost profits, loss of use, property damage beyond direct physical damage caused by our negligence, personal injury except where caused by our gross negligence or willful misconduct, or damages related to ongoing pest activity despite treatment. Our total cumulative liability for any claims arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim during the twelve-month period preceding the event. This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise. These limitations reflect a reasonable allocation of risk and form an essential basis of our pricing structure. Certain jurisdictions do not permit limitation of liability for certain damages; in such cases, our liability shall be limited to the maximum extent allowable.

Intellectual Property

All content, materials, trademarks, service marks, logos, trade names, and proprietary information displayed on our website, marketing materials, service documentation, and communication platforms are the exclusive property of North Dakota Pest Control or our licensors. This includes but is not limited to treatment protocols, inspection methodologies, custom service plans, photographic documentation, written reports, and educational content. You are granted a limited, non-exclusive, non-transferable license to access and use our materials solely for personal, non-commercial purposes related to your receipt of services. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any of our intellectual property without express written permission. Any unauthorized use constitutes infringement and may result in legal action. Client-provided information remains your property, though you grant us a license to use such information for service delivery and internal business purposes.

Governing Law

These Terms and any disputes arising from or relating to our services shall be governed by and construed in accordance with the laws of the State of North Dakota, without regard to its conflict of law principles. Any legal action, proceeding, or dispute resolution shall be brought exclusively in the state or federal courts located within Burleigh County, North Dakota, or the county where the serviced property is situated, at our election. You hereby consent to the personal jurisdiction and venue of such courts and waive any objection to jurisdiction or venue on any ground. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Should any provision of these Terms be held invalid or unenforceable under North Dakota law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

Changes to Terms

We reserve the right to modify, amend, or update these Terms at any time and for any reason, including changes in legal requirements, industry standards, or our business practices. Material changes will be effective thirty days after posting updated Terms to our website or upon direct notification to active clients. Continued use of our services following such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically. If you do not agree with modified Terms, you must discontinue service use and notify us in writing to terminate any ongoing service agreement. Changes will not apply retroactively to disputes arising prior to the effective date of modification.
